Platforma labapartika.lv (turpmāk tekstā - "Platforma") pieder un tās darbību nodrošina komersants eMaksa SIA, reģistrācijas Nr. 41503074939, juridiskā un pasta adrese: Daugavpils, Telts iela 1 - 8, LV-5422, (turpmāk tekstā - "Īpašnieks").
Klients (turpmāk tekstā - "Klients") var izmantot platformu, lai aplūkotu, pasūtītu un apmaksātu dažādus pārtikas un nepārtikas produktus (turpmāk tekstā - "produkti") saskaņā ar lietošanas noteikumiem un nosacījumiem.
Produktu pārdevējs ir komersants Sabiedrība ar ierobežotu atbildību "KARP", reģistrācijas Nr. 41503022104, juridiskā un pasta adrese: 2. Preču iela 13 - 5, Daugavpils, LV-5401 (turpmāk tekstā — "Pārdevējs").
Izmantojot platformu, klients piekrīt šiem noteikumiem un nosacījumiem, un klientam ir pienākums ievērot gan šos noteikumus un nosacījumus, gan jebkādus platformā atsevišķi publicētus norādījumus. Šie noteikumi un nosacījumi ir saistoši arī pārdevējam.
Tirdzniecības teritorija, ēkas vai telpas lietderīgās platības daļa vai pārvietojamais mazumtirdzniecības punkts, kur ar tirdzniecību nodarbojas pārdevējs, (turpmāk tekstā - "tirdzniecības vieta").
2. Platforma
Lai lietotu platformu, klientam nav nepieciešama identifikācija. Klienti platformā iegūst informāciju par produktiem, pakalpojumiem, akcijām un īpašiem piedāvājumiem.
Pirms pasūtījuma veikšanas jāapstiprina mobilā tālruņa numurs.
3. Produktu klāsts un cenas
Platformā norādītais produktu klāsts ir aktuāls un pieejams pasūtīšanai. Visas cenas ir norādītas ar ietvertu PVN un citiem piemērojamajiem nodokļiem un nodevām.
4. Pasūtījuma veikšana
4.1. Pasūtījums
Klients var izmantot platformu, lai izveidotu un apmaksātu pasūtījumu. Pasūtījums tiks sagatavots saņemšanai tirdzniecības vietā vai piegādāts uz norādīto adresi. Klientam tiks paziņots saņemšanas kods.
Platformā veiktie pasūtījumi ir saistoši klientam. Pasūtījumam tiek piešķirts četru ciparu kods, kas ļauj klientam saņemt pasūtījumu. Klientam jānodrošina, ka kods netiek izmantots neatļauti. Tomēr klients var pilnvarot citu personu saņemt pasūtījumu, nododot kodu šai personai. Ikviens kods ir unikāls un to var izmantot tikai vienu reizi. Pārdevējs nav atbildīgs par to, ka kodu neatļauti izmanto trešās personas, ja vien kods šādām personām nav kļuvis pieejams pārdevēja kļūdas dēļ.
4.2. Pasūtījuma apmaksa
Klients var apmaksāt pasūtījumu saņemšanas brīdī.
Klients var apmaksāt pasūtījumu izmantojot tiešsaistes maksājumu risinājumus Klix (Citadele) vai EveryPay (SEB, Swedbank).
Ņemot vērā produktu īpašības, klients pēc pasūtījuma veikšanas un tā apmaksas nav tiesīgs no tā atteikties, ja pasūtījuma izpilde jau ir uzsākta. Klients apzinās, ka produkti ir pārtikas produkti un dzērieni, kuri ātri bojājas un kuru derīguma termiņš ir īss, tādēļ saskaņā ar vietējiem tiesību aktiem atteikuma tiesības nav piemērojamas.
4.4. Novēlota pasūtījuma saņemšana
Tiek darīts viss iespējamais, lai pasūtījumu sagatavotu līdz norādītajam saņemšanas laikam. Klientam pasūtītie produkti ir jāsaņem līdz norādītajam saņemšanas laikam. Pasūtījumi tiek uzglabāti 25 minūtes no brīža, kad tie ir gatavi saņemšanai, taču jebkurā gadījumā ne vēlāk kā līdz tirdzniecības vietas darba laika beigām. Ja klients nesaņem pasūtījumu šajā laikā, tas tiek utilizēts. Klients nav tiesīgs saņemt kompensāciju vai atgūt par pasūtījumu samaksāto naudu, ja klients nokavē pasūtījuma saņemšanu. Lai nodrošinātu produktu drošību, ņemot vērā to īpašības, produktus klientam nevar izsniegt pēc šajā sadaļā norādītā saņemšanas laika beigām.
4.5. Sūdzības par produktiem
Sūdzības par produktiem jāiesniedz uzreiz tirdzniecības vietā, vai arī jāsazinās ar pārdevēja atbalsta dienestu.
5. Pārējie noteikumi
Īpašnieks pēc saviem ieskatiem var pilnībā vai daļēji mainīt, atjaunināt vai dzēst platformas funkcionalitāti un saturu. Šādas darbības var arī ietvert šo lietošanas noteikumu un nosacījumu grozīšanu. Klientam saprātīgā termiņā iepriekš tiek paziņots par būtiskākajiem grozījumiem. Lai turpinātu platformas izmantošanu, klientam ir jāpiekrīt lietošanas noteikumos un nosacījumos veiktajām izmaiņām.
Klients ir atbildīgs par sniegtās informācijas pareizību, saņemšanas koda glabāšanu, kā arī atbilstošu datu aizsardzības pasākumu īstenošanu viedierīcē. Klients ir atbildīgs par visiem darījumiem, kas platformā tiek veikti.
Visus strīdus un domstarpības, kas ir saistītas ar šo Līgumu, Puses vispirms risina sarunu ceļā. Ja vienošanos nav iespējams panākt, visi strīdi un nesaskaņas, kas rodas sakarā ar šo Līgumu, atrisināmi tiesas ceļā saskaņā ar Latvijas Republikas likumdošanu.
Strīdu risināšanai klienti var izmantot patērētāju strīdu risināšanas platformas.
